RideMarket is a Canadian powersports marketplace operated by RideFirst Finance. You can browse dealer and private-seller listings and use standard marketplace features without submitting a financing request. Financing-related tools, where offered, are optional and separate from the marketplace transaction. By accessing or using RideMarket or another RideFirst Finance service covered by these Terms, you agree to be bound by them.

Section 01

Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and RideFirst Finance ("RideFirst," "we," "us," or "our"), the Alberta-based business that operates RideMarket.

By accessing ridemarket.ca or ridefirstfinance.ca, creating an account, submitting or responding to a marketplace listing or inquiry, using an optional financing tool, or otherwise using a feature covered by these Terms, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

General browsing of public marketplace listings does not require you to submit a financing request. Your continued use of the platform after any update to these Terms constitutes acceptance of the revised Terms.

Description of Services

RideFirst Finance operates RideMarket and related powersports technology services. These may include:

RideFirst Finance does not itself extend credit or make lending decisions through RideMarket. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, subject to applicable law.

Eligibility

RideMarket is intended primarily for users in Canada. Public marketplace listings may be browsed without creating an account. To create an account, submit a private listing, use features that require a binding submission, or submit a financing request, you must:

Your Account, Listings, Inquiries and Information

When you create an account, submit a listing, send an inquiry, request an appraisal or trade response, or use another interactive feature, you agree that the information you provide is accurate, complete, and current.

RideMarket is a marketplace operated by RideFirst Finance. RideFirst Finance does not make lending decisions, does not guarantee financing approval, and is not the buyer or seller in a marketplace vehicle transaction.

Violation of these prohibitions may result in immediate termination of access and may be referred to law enforcement authorities.

Intellectual Property

Content and technology owned by RideFirst Finance and used across RideMarket and related RideFirst Finance services โ€” including logos, design elements, text, software, graphics, and platform functionality โ€” is protected by applicable Canadian copyright and intellectual property law.

Third-party listing content remains subject to the rights of the applicable dealer, seller, manufacturer, photographer, or other rights holder. You may not reproduce, distribute, modify, or create derivative works from RideMarket or RideFirst Finance proprietary content without prior written consent. Dealers granted access to feeds, tools, or other platform integrations do so under the applicable dealer agreement or permission granted to them.

Disclaimer of Warranties

RideMarket and related RideFirst Finance services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, RideFirst Finance disclaims all warranties, including:

Limitation of Liability

To the maximum extent permitted by applicable law, RideFirst Finance, as operator of RideMarket, and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the platform, including but not limited to:

In no event shall our total liability to you for any claim exceed the amount you paid to us (if any) in the six months preceding the claim.

Some Canadian provinces do not allow exclusion of certain implied warranties or limitations of liability. In such jurisdictions, our liability is limited to the greatest extent permitted by applicable law.

Indemnification

You agree to indemnify, defend, and hold harmless RideFirst Finance, as operator of RideMarket, and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to:

Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Province of Alberta and the applicable federal laws of Canada, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms or your use of our platform shall be resolved in the courts located in Alberta, Canada, and you consent to the jurisdiction of those courts.

We encourage you to contact us first to attempt to resolve any dispute informally before initiating formal legal proceedings.

Changes to These Terms

We reserve the right to update these Terms at any time. When we make material changes, we will update the effective date shown at the top of this document. We may also provide notice through the platform or by email.

Your continued use of the platform following any changes constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the platform.
